Movements such as March and March, Operation Dudula and some of the smaller like-minded groups have repeatedly linked their recent xenophobic activities and the violence, looting, damage to property and displacement of people which flowed from these activities, to the Constitutional Court’s judgement of 7th July in what is now commonly referred to as the Scalabrini case (Scalabrini Centre of Cape Town and Another v Minister of Home Affairs).
